Conditions of sale

  1. The auction takes place for account of the consignors.
  2. The sale is by upward bidding against cash payment of the hammer price in Euro’s to which 25% costs will be added, whichever way you place your bids. Any postage and insurance costs will be charged to the buyer.
  3. Online bidding is free of extra charge. The bidder must register with the auctioneer for authorisation. The auctioneer is not responsible for any faults or malfunctioning connections which may occur during online bidding. The auctioneer is also not liable for any damage resulting from unsuccessful online bids, in any way whatsoever.
  4. Lots will be knocked down to the highest bidder; in case of dispute the auctioneer may put up and sell the lot in question again. Each lot shall be at the buyer’s risk after the fall of the hammer. Every buyer is personally liable for all purchases made; he therefore cannot claim to act for a third person. As a general rule lots will be called out at about 20% below the estimate. They can be sold above or below the estimate. The auctioneer reserves the right to depart from the above course.
  5. The auctioneer is entitled to refuse admission to the sales room and to refuse assignment of a lot.
  6. The auctioneer is entitled to waive payment in cash and to supply the merchandise against invoice. Payment must then be made within 10 days. Title remains with the owner until paid for in full. Foreign clients are requested to respect the exchange and import regulations of their countries. The auctioneer declines responsibility for any consequences resulting from contravention of such regulations.
  7. Interest of 1% per month or part of month will be charged if payment of the purchase price including the premium and any costs is not received within the stipulated period. The buyer is responsible for all fees and expenses involved in collection of any overdue debt.
  8. Should payment not take place immediately and the auctioneer is not prepared to waive cash payment, or if the person to whom a lot has been knocked down refuses to take delivery, the auctioneer is entitled to sell the lot again at the expense of the purchaser without it first being necessary to declare the purchaser in default by means of an injunction or similar indictment. In this case the first buyer is responsible for any lower proceeds, as well as for damages and costs. Any eventual higher proceeds are for the original owner.
  9. The descriptions in the catalogue have been made to the best knowledge and ability of the cataloguer who is not responsible for errors either to the buyer or to the consignor. Unless otherwise stated, the auctioneer guarantees the genuineness of all items sold. Lots of more than 20 items may not be returned for any reason whatsoever. The grading descriptions, made in accordance with generally accepted standards of classification, are to be considered only as the personal opinion of the cataloguer. All lots will be sold “as is”. For lots of more than 20 items the number of coins given in the catalogue is to be considered as approximate only. No lots purchased by floor buyers may be returned. Should, contrary to expectation, a lot be found not to be genuine - which must be proved to the satisaction of the auctioneer - it will be taken back within a maximum of 15 days after the last day of the relevant auction sale. Lots must in all cases be returned in exactly the same condition and presentation as they were put up for sale.
  10. The auctioneer reserves the right to combine lots or to split them up, to depart from the numerical order of the catalogue and to withdraw certain lots from the sale.
  11. Bidders may entrust their orders to the auctioneer who will execute them entirely in the interests of the bidders and without additional costs. A deposit or bank reference may be required from buyers unknown to the auctioneer. When identical mail bids are received by the auctioneer preference is given to the first bid received. Unlimited bids can be refused. Bids in writing for less than about 20% below the estimated value will not be accepted.
  12. Dutch law applies to any disputes arising from the auction. Should any such disputes arise they will be submitted to the District Court of ‘s-Hertogenbosch, taking into account the competence of the Sector Kanton.
